By accessing or using Oilpatch Broker, operated by Sooner Brokers LLC, you agree to be bound by these Terms of Service and all applicable laws and regulations.

User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for:

• Maintaining the security of your account
• All activities that occur under your account
• Keeping your password secure
• Notifying us of any unauthorized use

Marketplace Rules

When using our marketplace, you agree to:

• Provide accurate listing information
• Honor your commitments as a buyer or seller
• Communicate professionally with other users
• Follow all applicable laws and regulations

Prohibited Activities

You may not:

• Post false or misleading information
• Engage in fraudulent activities
• Harass or abuse other users
• Violate any applicable laws
• Sell prohibited or restricted items (see Prohibited Products section below)
• Attempt to circumvent our verification or compliance processes
• Create multiple accounts to evade restrictions
• Engage in money laundering or terrorist financing activities

Prohibited Products and Services

The following items and services are strictly prohibited on our platform:

• Weapons and Dangerous Items: Firearms, ammunition, explosives, weapons, knives designed for harm
• Illegal Substances: Illegal drugs, controlled substances, unprescribed pharmaceuticals
• Stolen or Counterfeit Goods: Items obtained illegally or fake branded products
• Adult Content: Pornography, adult entertainment services, escort services
• Financial Services: Investment schemes, pyramid schemes, gambling services
• Restricted Agricultural Products: Raw milk products, home-processed meats without proper licensing, exotic or endangered animals

Seller Verification Requirements

To ensure marketplace safety and comply with financial regulations, sellers must complete verification processes:

• Basic Verification: Email verification and Stripe Connect account setup
• Enhanced Verification: Identity verification required for transactions over $1,000
• Business Verification: Business registration and documentation for high-volume sellers
• We reserve the right to request additional verification based on transaction patterns and risk assessment

Transaction Limits and Monitoring

To protect all users, we implement transaction limits and monitoring:

• Daily and monthly transaction limits based on verification level
• Automated monitoring for suspicious activity
• Manual review of high-value transactions
• Compliance with anti-money laundering regulations

Platform Compliance

We are committed to maintaining a safe and compliant marketplace:

• Regular review of seller accounts and listings
• Cooperation with law enforcement when required
• Reporting of suspicious activities to relevant authorities
• Compliance with payment processor requirements and regulations

Termination

We may terminate or suspend your account if you violate these terms. Upon termination:

• Your access will be immediately revoked
• Your listings will be removed
• You may not create a new account without permission

Fees and Payment Processing

By using our marketplace, you agree to the following fee structure and payment terms:

Platform Fees

• Seller Transaction Fee: 3.7% of the total sale price for each completed transaction
• Fee Calculation: Fees are automatically calculated and deducted when payment is processed
• Fee Transparency: All fees are clearly displayed before transaction completion
• No Hidden Fees: The 3.7% platform fee covers all marketplace services

Payment Processing

• Payment Processor: All payments are processed securely through Stripe Connect
• Stripe Fees: Payment processing fees (2.9% + 30¢) are included in our platform fee
• Seller Payouts: Sellers receive 96.3% of the sale price (100% - 3.7% platform fee)
• Payout Timing: Funds are typically available within 2-7 business days after sale

Free Services

• Listing Creation: Creating and posting listings is completely free
• Account Registration: No fees for creating buyer or seller accounts
• Browsing and Searching: Viewing listings and using search features is free
• Messaging: Communication between buyers and sellers is free

Fee Changes

• Advance Notice: Any changes to our fee structure will be announced at least 30 days in advance
• Grandfathering: Existing users may be offered special rates when fees change
• Right to Discontinue: You may close your account if you disagree with fee changes

Payment Terms and Refunds

Understanding payment processing and refund policies:

• Payment Methods: We accept all major credit cards, debit cards, and bank transfers through Stripe
• Transaction Disputes: Buyers may request refunds within 30 days of purchase for valid reasons
• Seller Responsibility: Sellers are responsible for honoring sales and providing accurate product descriptions
• Platform Protection: We may hold funds in cases of disputes until resolution
• Chargeback Protection: We work with sellers to resolve payment disputes and chargebacks
